Carroll County Circuit Court and Clerk's Office

Carroll County Family Court Records: Types and Contents

The Circuit Court handles all family law filings in Carroll County. This covers a wide range of cases. Divorce is among the most common. Under Family Law Article Section 7-103, Maryland recognizes three grounds for divorce: mutual consent of both parties, a six-month separation, and irreconcilable differences. Divorce records held by the clerk include the petition, the summons and proof of service, any financial statements, agreements on property division, custody plans, and the final judgment of divorce. Many of these documents are public, though financial statements in support cases carry restricted access under Maryland court rules. The docket entry for each filing is visible through the statewide Case Search portal, but the full text of documents requires a visit to the courthouse or a copy request.

Child custody and visitation cases, child support proceedings, paternity actions, and name changes are also handled here. Domestic violence protective orders fall under Family Law Article Section 4-504. A person seeking a protective order can file at either the circuit court or the district court. Interim orders can be issued the same day in emergency situations. Adoption and guardianship cases are filed at the circuit court but are sealed by statute and are not available to the public through standard record access requests.

Getting Copies of Carroll County Family Court Records

Carroll County Clerk's Office copy fees follow Maryland's standard schedule. Each page costs $0.50. A certified copy, which carries the court's Gold Seal and is accepted as official, costs $5.00 plus the per-page copy fee. Exemplified copies cost $10.00 plus copy fees. A certified copy of a marriage license is $5.50, and a plain copy of a marriage license is $0.50. If you need documents mailed back to you, a $2.00 mail-back fee applies. Motions to modify existing orders cost $31.00 to file.

What Carroll County Family Court Records Are Public

Maryland Rules 16-901 through 16-912 set the framework for public access to court records statewide. Under those rules, most civil court records are open. Divorce decrees, custody orders, child support judgments, protective orders, and paternity findings are all available to any member of the public who requests them. You do not need to be a party to the case, and you do not need to explain why you want the records.

Some categories are restricted. Adoption records are sealed and cannot be obtained through standard record requests. Juvenile delinquency files and CINA cases are confidential. Financial statements filed in child support proceedings are not open to the public. If a judge has entered a sealing order on a particular case, that applies to all parties and members of the public alike. The clerk will tell you that records are sealed but cannot share what is in them.

Carroll County does not currently offer a way to order records electronically through a self-service portal. Requests go through in-person or mail channels.
