Family Law Case Types for Severn Residents

The Circuit Court for Anne Arundel County handles all major family law matters. Divorce filings are among the most common. Under Maryland law, grounds for absolute divorce include mutual consent when both parties agree and have a written settlement, a six-month separation with a written settlement, and a twelve-month separation without one. The court can also address property division, alimony, and related financial matters as part of the divorce proceeding.

Custody cases are filed at the Circuit Court when parents cannot agree on legal or physical custody arrangements. Legal custody covers who makes major decisions for the child, such as education and healthcare. Physical custody refers to where the child lives. Child support is set using the Maryland Child Support Guidelines. The formula takes into account both parents' gross incomes, the number of children, work-related childcare costs, health insurance, and the custody arrangement. Protective orders are available to people in a qualifying relationship with an abuser. Under Maryland Family Law Article Section 4-504, a protective order can require the abuser to leave a shared home, stay away from the victim's workplace or the children's school, and temporarily award custody. Emergency protective orders can be issued by a District Court judge at any hour, including nights and weekends.
