Types of Rockville Family Court Cases

The Circuit Court in Rockville handles the full range of family law matters for Montgomery County. Divorce is the most common filing. Maryland Family Law Article § 7-103 sets out the grounds for absolute divorce. A 12-month separation period is the most commonly used basis. The court also handles limited divorce, which separates the parties legally without dissolving the marriage.

Custody and visitation cases cover both legal and physical custody. The court issues initial orders, handles modifications, and enforces existing orders. Maryland uses the best interest of the child standard in all custody decisions. Joint custody arrangements are common when both parents can cooperate. Contested custody cases go to hearing, where a judge makes the determination based on evidence and testimony.

Child support cases are handled in the Family Department. Maryland uses an income shares model to calculate support. The court can issue new orders, modify existing ones, and enforce support obligations through wage garnishment or contempt proceedings. Adoptions and guardianships are also filed at the Circuit Court level. Protective order cases under Family Law Article § 4-504 can be filed here as well, particularly in contested or long-term cases that originate in District Court.
